The law requires that assets held in your own name, outside of a trust or certain vehicles (e.g., joint tenancy, trust account, etc.), be administered by the probate process. Smaller estates qualify for a simpler and quicker form of administration, often without the need for a court procedure. Generally, assets must be identified, debtors and beneficiaries notified, taxes and debts paid, and proper distributions made. If there are disputes over property or assets, these must be negotiated or litigated.
The decedent may or may not have a will. If there is no valid will, the decedent has died "intestate" and property is distributed according to California state law. In this situation, probate is required if alternative arrangements are not in place.
Court costs for probate can be significant, increasing with the size of the estate. The process typically takes a year or more, a long time if you are awaiting a bequest.
